What are the required legal steps to officially hire an employee in Armenia?

There are two legislative areas with which the employer must comply during the hiring process:

  1. Labor Legislation:
    Labor legislation requires the parties involved in the employment relationship to either conclude a written employment contract or for the employer to issue an individual legal act confirming the employee’s acceptance for work.
  2. Tax Legislation:
    Tax legislation requires the employer to register the employee in the tax system no later than the first half of the day on which the employee begins work.

Can I hire a foreign employee in Armenia?

The short answer is yes. However, depending on the citizenship of the potential employee, a work permit may be required.

For example, citizens of China, India, France, the Philippines, Georgia, and many other countries cannot work in Armenia without a work permit.

On the other hand, citizens of Russia, Kazakhstan, and Belarus have the right to work in Armenia without a work permit.

If I want to hire a foreigner who requires a work permit, how do I do that?

In Armenia, the work permit process is entirely handled by the potential employer. The employee only needs to follow the employer’s instructions during the process.

Employers in Armenia must follow a complex procedure to formally terminate an underperforming employee, ensuring compliance with labor laws.

What are the key elements that must be included in an employment contract in Armenia?

An employment contract in Armenia must include the following key elements:

  • Salary amount,
  • Job title,
  • Work schedule,
  • Place of work.

It is crucial to carefully consider each of these conditions before finalizing the agreement. Any amendments to these clauses require the employee’s consent. If the employee does not agree to the changes, the process becomes more complicated.

Are there any specific regulations for hiring remote employees in Armenia?

Yes, recent amendments to Armenia’s labor legislation allow for remote employment. However, remote work requires the employer’s agreement, and the terms of remote employment must be documented in writing. This ensures clarity and compliance with labor laws.
